THE IYANEDESIGNS.COM RESERVES THE RIGHT TO UPDATE THE TOU/ T&C AT ANY TIME WITHOUT NOTICE TO YOU. YOUR USE OF THE IYANEDESIGNS.COM WEBSITE AND SERVICES SIGNIFIES YOUR COMPLETE ACCEPTANCE OF THIS TOU/ T&C.
2. DESCRIPTION OF SERVICES
The iyanedesigns.com offers graphic design, videography, photography, offline/ online product selling, social media management, social media marketing, YouTube channel management, brand promotion, 2D or 3D designs, branding, digital graphics selling on www.iyanedesigns.com, personal or group interview for your own channel or our official channel etc. and all are also available with customization*.
3. LIMITATIONS OF USE
You may use any service purchased from the iyanedesigns.com website for:
3A Work
3A (1) You may modify, or have a third party perform the modifications of any design template/ service after purchase to meet your specific requirements.
3A (2) You agree that all iyanedesigns.com service is provided to you as displayed on the IyaneDesigns.com or Iyane.in the website or on the official Instagram/ Twitter handle.
3A (3) You also agree that the service provided by IyaneDesigns or iyane.in are professional format files and as such any colour, text, or structural modifications performed on iyanedesigns.com require the use of service software which may need to be acquired through third party software providers.
3A (4) You may use a purchased service without any restrictions as required for your personal or commercial use.
3A (5) You may not resell a purchased service as a template/ service or as part of an unfinished web template/ service, or any other unfinished design/ service product.
3B Use of Service
3B (1) You also agree that we will provide exclusive service to only one client at a time. As soon as the agreement for any currently running work is over, iyanedesigns.com can sign an agreement for the same work with another brand or any other client.
3B (2) Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including The iyanedesigns.com or other licensed employee, host, or representative, as well as other members or visitors on the site, is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
3C Use of data
3C (1) You also agree that the iyanedesigns.com can only use your data (Name, Email ID, Phone number, DOB, Address, and purchase/ order history) to improve our own business and improve its quality, as well as if you have subscribed to iyanedesigns.com newsletter then we send you a promotional email along with any information.
3C (2) You also agree that in the interview given with the iyanedesigns.com, I (myself) will tell whatever I have told/have told myself, and the iyanedesigns.com has made some kind of Have not even pressured, I will give my interview to the iyanedesigns.com with my desire.
3C (3) You also agree that iyanedesigns.com can upload my interview given to iyanedesigns.com on any of its official channels like YouTube, Instagram etc. for which I am going to do today or after today anytime in future does not require any royalty amount for that.
3C (4) You also agree that if any of my interviews or any service that I have taken from iyanedesigns.com, the iyanedesigns.com upload it on any of its channels or any portfolio, then I dose not have any objection for today or in future. The content uploaded on the iyanedesigns.com channel or iyanedesigns.com portfolio is completely entitled to iyanedesigns.com.
3C (5) You also agree that if I have taken an exclusive service from the iyanedesigns.com, Iyanedesigns.com can show it in the portfolio, I have no objection to it but iyanedesigns.com cannot resell it to another client the same design ("can not be resold" this statement only applies to logo design).
3C (6) You agree that you cannot use the data available on the iyanedesigns.com website or any official account without the written permission of iyanedesigns.com.
3D Working Partner
3D (1) If the iyanedesigns.com is a design partner or event partner or media partner or another kind of partner in any event/function or any kind of work partner with any brand or any person, then it should not be taken to mean that the iyanedesigns.com cannot do the same thing with any other brand or person at the same time or any other event or function unless an exclusive agreement is not signed with any brand or any person.
3D (2) If you are working with iyanedesigns.com (as a brand/ person) this does not mean that you cannot do the same thing with another brand unless iyanedesigns.com has signed a special agreement with you. (Please note that this condition does not apply to an employee of the iyanedesigns.com)
3E Use of Logo
Without any written permission, you cannot use the logo/symbol or name of iyanedesigns.com in any of your works such as personal or commercial. On getting this done, iyanedesigns.com will always reserve the right to take legal action.
4. COPYRIGHTS & TRADEMARKS
4.1 - **Non-exclusive service:
Non-Exclusive services are sold more than once. All Non-Exclusive services are under the copyright protection of iyanedesigns.com By purchasing a Non-Exclusive service, you accept that iyanedesigns.com may sell the same Non-Exclusive service again to a different client. You accept and understand that iyanedesigns.com has the full discretion to decide how many times a Non-Exclusive service is resold to the purchasing clientele.
4.2 - **Exclusive service:
Exclusive services will be sold only once, such as logos, product design, etc., but where it is about any service such as YouTube channel management or social media management or a graphic partner with a brand, it can be sold to a customer until the agreement with him has not expired. By purchasing an exclusive service all copyright ownership and rights will be transferred to you and the exclusive service is removed from the iyanedesigns.com website as soon as possible / out of stock (this applies for logo design only).
5. PAYMENT/ WORKING POLICY
To use any service, you have to pay first. Once the payment amount is received, the iyanedesigns.com will start working on the service taken by you, which will be timed according to the convenience of iyanedesigns.com and before/after you can not create any type of pressure on the iyanedesigns.com, like that now my work should be done now or in a particular time slot. Since the time limit is necessary we understand that so it will be talked to iyanedesigns.com before placing the order, or the iyanedesigns.com will tell the time to complete the work as per your convenience.
5.1 If we working on any of the projects, we will give the first three* revisions free of cost, that is, once we deliver the first draft, you will be able to request for changes in your running project three times and it's free. (If there is any small change in draft two, then you will have only two other free revenge limits. Similarly, if you make any changes in the third draft, then you will have only one free change left.)
5.2 Free changes will be applicable only on the project that is currently in progress, these free changes cannot be transferred to any other project or any person.
5.3 After the free changes, if you still required change in the running project then you have to be paid which is 15% of the project cost and the minimum is Rs 50 (for India, Pakistan, Sri Lanka and Bangladesh) and USD 5 (for other countries). The amount will depend on the changes*.
5.4 If your design change more than 50% after three free revision then you have to be paid extra which is 50% of the project cost. For example, if your project cost $100 then you need to pay $50 extra as changes charge so the final cost of the project is $150.
5.5 After final delivery of any running project, if again any change required, then it will be taken in a new project and its cost will be applied according to the new project.
5.6 Three free revisions will not be applicable for all task/project/work, there can be zero on some task/project, the three free revisions mentioned here are the maximum number of revisions that are provided with the project at no extra charge.
5.7 The iyanedesigns.com is completely free to work with any brand or any group or with any person.
5.8 The period of three free revisions is valid 15 days from the start of the ongoing project, after that, it will have to pay 15% of the project for any kind of change.
5.9 During the ongoing project, if the client does not give any kind of response for 15 days, then the project will automatically be considered closed and if any changes are made after closing the project, it will be treated as a new project. And will have to pay accordingly.
5.10 If any project is to be started in different sizes (e.g. if you need a poster/ PSD etc. design but you also require this in 10 different sizes) of design or the client need unlimited revision, then the project cost will be applicable per hour and other conditions will remain the same.
5 A. Third-Party Work
If you are working for one of your clients (where you as a mediator) then you will be the client for us and all the conditions will apply to you, as we are not connected to your client.

7. TYPOGRAPHICAL ERRORS
If the iyanedesigns.com product is mistakenly listed at an incorrect price, iyanedesigns.com reserves the right to refuse or cancel any orders placed for the product listed at the incorrect price. The iyanedesigns.com reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit/ debit card, Netbanking or UPI charged. If your credit/ debit card, Netbanking or UPI has already been charged for the purchase and your order is cancelled, The iyanedesigns.com shall issue a credit to your payment source account in the amount of the incorrect price.
8. TERMINATION
These terms and conditions apply to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by iyanedesigns.com without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.
9. NOTICE
The iyanedesigns.com may deliver notice to you employing e-mail, a general notice on the site, or by another reliable method to the address you have provided to the iyanedesigns.com.
10. THIRD-PARTY LINKS
In an attempt to provide increased value to our visitors, iyanedesigns.com may link to sites operated by third parties. However, even if the third party is affiliated with iyanedesigns.com, iyanedesigns.com has no control over these linked sites, all of which have separate privacy and data collection practices, independent of iyanedesigns.com. The iyanedesigns.com does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, iyanedesigns.com is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, the iyanedesigns.com reserves the right to block or remove communications or materials that it determines to be
(a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; another intellectual property right of another or (d) offensive or otherwise unacceptable to the iyanedesigns.com in its sole discretion.
13. LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of India the parties submit to the jurisdiction of the Court of Sikar, Rajasthan, IND regardless of conflicts of law rules, and Sikar Courts competent to hear appeals from them.
